TRUSTEE'S SALE OF 17021 Dickenson Hwy, Clinchco, Virginia

In execution of a Deed of Trust dated August 26, 2011, and recorded in the Office of the Clerk of the Circuit Court of Dickenson County, Virginia in Deed Book 489, Page 450; and with the undersigned being appointed Substitute Trustee by document of record, the undersigned Substitute Trustee will offer for sale at public auction all that certain property, together with all improvements thereon and appurtenances thereunto belonging, more particularly described in the said Deed of Trust, having street address of 17021 Dickenson Hwy, Clinchco, Virginia 24226; having parcel identification numbers of 3030 and briefly described as follows:

BEGINNING at a stake in the west line of Williams Street, a corner of Lot Number 238; thence with the west line of Williams Street, S 24 05 W 41.5 feet to a stake, a corner of Lot Number 236; thence leaving Williams Street and with one line of Lot Number 236, N 70 26 W 81.8 feet to a stake on the east bank of McClure River; thence down the east bank of the river N 16 42 E 44 feet to a stake, a corner of Lot Number 238, thence leaving the east bank of the river and with one line of Lot Number 238, W 68 47 E 87 3 feet to the BEGINNING.

AND BEING the same property conveyed unto Scooda Bell Nichols, by a deed dated May 12, 1978, a copy of which deed is of record in the Clerk's Office of the Circuit Court of Dickenson County, Virginia, in Deed Book 191, Page 81 reference to which deed is hereby made for a more particular description of the property herein mentioned.

Sale shall be made subject to all rights, reservations, restrictions, covenants, and easements of record in the aforesaid Clerk's Office which may affect the title to the real property hereinabove mentioned.

Date of Sale: July 19, 2024

Time of Sale: 12:00 p.m.

Place of Sale: Front Steps of the Dickenson County Courthouse, 119 Court House Lane, Clintwood, Virginia.

Terms of Sale: The Successful Bidder shall make a ten percent (10%) deposit at the time of sale, subject to the exception that the Trustee reserves the right to modify or waive the deposit requirement if the Noteholder is the successful bidder. The entire amount of the successful bid must be paid in full by certified or bank cashier's check within thirty (30) days after sale, and Time is of the Essence as to the closing date and payment of the purchase price. The Property will be sold “AS IS, WHERE IS” and title will be conveyed by Special Warranty Deed. Risk of loss will pass at the time of sale, and neither the Trustee nor the Noteholder will deliver possession of the Property to the successful bidder. The purchaser of the Property will be required to pay all closing costs except the Grantor's Tax, and real estate taxes will be pro-rated as of the original date of sale. The purchaser of said premises will at the time and place of sale, sign a memorandum of purchase and an agreement to comply with the terms and conditions of the sale herein contained. The Bidding will be kept open after the property is struck down; and in case any purchaser shall fail to comply with any of the above conditions of sale, the property so struck down will be again put up for sale under these same terms of sale, and the original purchaser will be held liable for any deficiency there may be between the sum for which the property may be purchased on the resale, and also for any costs or expenses incurred on such resale. If for any reason the Substitute Trustee fails to convey title to the Property to the purchaser, the purchaser's sole remedy is the return of the Deposit paid by the purchaser on the date of the foreclosure sale.
