   In execution of a certain Deed of Trust dated May 5, 2009, in the original principal amount of $118,500.00 recorded in the Clerk’s Office, Circuit Court for Dickenson County, Virginia, in Book 467 at Page 606 as Instrument No. 090001232. The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Dickenson County, 293 Main St., Clintwood, Virginia, or any such temporary alternative Circuit Court location designated by the Judges of the Circuit Court, on March 11, 2026, at 3:30 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows:         
    ALL THAT CERTAIN PARCEL OF LAND SITUATED ON THE WATERS OF CRANESNEST RIVER, IN THE CLINTWOOD MAGISTERIAL DISTRICT OF DICKENSON COUNTY, VIRGINIA AND MORE FULLY DESCRIBED AS FOLLOWS: BEGINNING AT A HICKORY IN THE LINE OF THE GILMER FLEMING; THENCE DOWN THE CREEK LINE TO THE LINE OF THE CLINCHFIELD COAL CORPORATION; THENCE WITH THE CLINCHFIELD LINE TO A DOUBLE CHESTNUT ON THE SOUTH SIDE OF THE HILL; THENCE AN ESATERN COURSE WITH THE CLINCHFIELD LINE TO A HICKORY NEAR THE TOP OF THE HILL AND IN THE LINE OF THE TRACT OF LAND BOUGHT BY RUFUS FLEMING FROM THE CLINCHFIELD; THENCE WITH GILMER FLEMING LINE TO THE HICKORY AT THE BEGINNING, CONTAINING ABOUT TWENTY (20) ACRES, MORE OR LESS, AND BEING TRACT NO. 1 OF THE LAND CONVEYED TO NOEL FLEMING BY MAGGIE FLEMING BY DEED DATED DECEMBER 17, 1957, AND OF RECORD IN DEED BOOK 116, PAGE 88 OF THE CIRCUIT COURT CLERK`S OFFICE OF DICKENSON COUNTY, VIRGINIA. LESS AND EXCEPT THE FOLLOWING PIECES OF PROPERTY DESCRIBED IN: DEED BOOK 365 PAGE 074, RECORDED 06/04/2001 CONSISTING OF 1.5 ACRES TO BRIAN & MELANIE BANKER; DEED BOOK 435 PAGE 599, RECORDED 03/12/2007 CONSISTING OF 1.0 ACRE TO ELIJAH AND MELISSA OWENS; DEED BOOK 439 PAGE 527, RECORDED 04/11/2007 CONSISTING OF 2.0 ACRES TO RITCHIE TURNER; DEED BOOK 449 PAGE 330, RECORDED 03/03/2008 CONSISTING OF 1.0 ACRE TO BURL MOONEY, ET AL.; DEED BOOK 461 PAGE 795. RECORDED 01/21/2009 CONSISTING OF 2.0 ACRES TO KATHY FLEMING LAWSON.   
  TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence.  If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
