VALUABLE REAL ESTATE SITUATE IN 
DICKENSON COUNTY

   In execution of a Deed of Trust dated August 14, 2015, and recorded in the Office of the Clerk of the Circuit Court of Dickenson County, Virginia in Deed Book 528, Page 131; and with the undersigned being appointed Substitute Trustee by document of record, the undersigned Substitute Trustee will offer for sale at public auction all that certain property, together with all improvements thereon and appurtenances thereunto belonging, more particularly described in the said Deed of Trust, having street addresses of 111 Factory Drive, Clintwood, Virginia 24228, and 5957 Dickenson Hwy., Clintwood, Virginia 24228; having parcel identification numbers of 208X 526A (#21805) and 208X 473 (#10984) and briefly described as follows:
     All Lot Numbers 25 and 26 in the Town of Clintwood and 1.659 acres, more or less, in Town of Clintwood in the Clintwood Magisterial District of Dickenson County, Virginia.

    BEING Lot Numbers 25 and 26, in the Grandview Addition to the Town of Clintwood, Virginia, as shown in Plat Book 1 Page 12, in the Clerk’s Office of Dickenson County, Virginia, and being the same property conveyed unto David Harrison Mullins and Donna Jean Mullins, husband and wife, as Tenants by the Entireties with Rights of Survivorship as at Common Law, by Deed dated November 19, 2010, and of record in Deed Book 482, Page 512, in the Circuit Court Clerk’s Office of Dickenson County, Virginia.

    BEGINNING at an iron pin found, a corner to two tracts of Ida Grethel Tuller; thence with one tract of Ida Grethel Tuller, N 70 26 16 E 146.42’ to an iron pin set; thence leaving Ida Grethel Tuller and with 4 new lines through the Town of Clintwood Property, S 25 58 00 E 68.71’ to an iron pin set; thence S 48 32 11 E 56.56’ to an iron pin set; thence S 79 53 22 E 112.40’ to a utility pole; thence S 81 37 46 E 109.12’ to an iron pin set, a corner to Lowell D. Huff; thence with Lowell D. Huff, S 85 53 38 E 150.00’ to an iron pin set in the R/W of Route T-1012; thence with Route T-1012, S 20 22 22 W 41.26’ to an iron pin set in the R/W of Route 83 to the right having the following dimensions: are length = 275.78’ radius = 600.43’ to an iron pin set; thence leaving the R/W of Route 83 and with the R/W of a paved road, N 20 35 18 W 123.98’ to an iron pin set, a corner to a second tract of Ida Grethel Tuller; thence with Ida Grethel Tuller, N 81 51 00 E 91.03’ to the BEGINNING, containing 1.659 acres, more or less, and being the same property conveyed unto JPMorgan Chase Bank, National Association, by Deed dated December 31, 2014, and of record in Deed Book 523, Page 206, in the Circuit Court Clerk’s Office of Dickenson County, Virginia. This subject property has now vested in David Harrison Mullins and Donna Jean Mullins. 
   Sale shall be made subject to all rights, reservations, restrictions, covenants, and easements of record in the aforesaid Clerk's Office which may affect the title to the real property hereinabove mentioned. 
    Date of Sale:  October 16, 2024 
     Time of Sale:  12:00 p.m.
     Place of Sale:  Front Steps of the Dickenson County Courthouse, 119 Court House Ln., Clintwood, Virginia. 
   Terms of Sale:  The Successful Bidder shall make a ten percent (10%) deposit at the time of sale, subject to the exception that the Trustee reserves the right to modify or waive the deposit requirement if the Noteholder is the successful bidder.  The entire amount of the successful bid must be paid in full by certified or bank cashier’s check within thirty (30) days after sale, and Time is of the Essence as to the closing date and payment of the purchase price.  The Property will be sold “AS IS, WHERE IS” and title will be conveyed by Special Warranty Deed.  Risk of loss will pass at the time of sale, and neither the Trustee nor the Noteholder will deliver possession of the Property to the successful bidder.  The purchaser of the Property will be required to pay all closing costs except the Grantor’s Tax, and real estate taxes will be pro-rated as of the original date of sale.  The purchaser of said premises will at the time and place of sale, sign a memorandum of purchase and an agreement to comply with the terms and conditions of the sale herein contained.  The Bidding will be kept open after the property is struck down; and in case any purchaser shall fail to comply with any of the above conditions of sale, the property so struck down will be again put up for sale under these same terms of sale, and the original purchaser will be held liable for any deficiency there may be between the sum for which the property may be purchased on the resale, and also for any costs or expenses incurred on such resale.  If for any reason the Substitute Trustee fails to convey title to the Property to the purchaser, the purchaser's sole remedy is the return of the Deposit paid by the purchaser on the date of the foreclosure sale.
